In New York, summonses issued for truck violations can be very expensive. New York State law provides significant fines and penalties for trucking violations compared to other traffic violations. It is also extremely common for the police to issue multiple summonses at a single stop, including “overweight” summonses, which typically run into the thousands of dollars.
New York State law requires corporations to be represented by counsel in criminal court cases. If your company misses its court date or does not have an attorney appear, then the company can be found guilty of the charges (including misdemeanor crimes) and maximum fines can be imposed. If the driver doesn't appear for a ticket in his or her name, the license may be suspended and/or an arrest warrant can be ordered. We have over thirty three combined years of experience representing and defending trucking companies and drivers charged with violating traffic and trucking laws. If you or your company have received trucking summons (es), it is best to retain an attorney that handles trucking violations on a regular basis.
At Jones & Black, P.C., we have a proven track record of either getting such violations completely dismissed, or significantly reducing such fines and other penalties on both the Company and the driver.

In New York, “overweight” fines are based on the percentage that a truck's actual weight is greater than the permitted weight. The following is the New York overweight fine schedule.
